Legal Challenge Over Point Judith Pond Oyster Farm Cites Lack of Public Notice

Attorney Mark Fay has filed a lawsuit against the Rhode Island Coastal Resources Management Council, contesting the approval of an oyster farm in Point Judith Pond.
Representing neighboring property owners, Fay argues that the neighbors were not informed about the project throughout its review and negotiation process, violating due process rights.
Despite his earlier objections, the council approved the project in October, following its public notice requirements.
The lawsuit aims to overturn this approval and restart the application and review process for the oyster farm, which is located in a strategically significant area as the last available lease under state aquaculture regulations.
